OGAI advisory on advertising and financial enablement of online money games (29 Jul 2026)

On 29 July 2026 the Online Gaming Authority of India advised app stores, cloud and telecom providers, banks, social media intermediaries, OTT platforms and advertising agencies to build internal safeguards against offering, aiding, advertising or financially enabling online money games under PROG Act Sections 5–7.

The Online Gaming Authority of India advisory dated 29 July 2026 (PDF), addressed to all persons whose operations may directly or indirectly involve offering, aiding, advertisement or financial enablement of online money games, restates that the PROG Act has been in force since 1 May 2026.

Directives on the page

  • Sections 5, 6 and 7 prohibit offering/aiding online money games, advertisements that promote or induce play, and financial transaction facilitation / fund authorisation.
  • Liability extends beyond primary operators to anyone who aids, abets, induces, promotes or facilitates online money gaming services.
  • Named risk categories include application stores, cloud providers, telecom/ISPs, banks and financial institutions, social media intermediaries, OTT platforms and advertising agencies.
  • Recipients must immediately review policies, disable non-compliant hosting/transactions/ads, and implement automated or manual internal compliance systems.
  • Non-compliance may trigger Section 14 blocking and Section 9 penalties (the advisory lists imprisonment/fine bands for Sections 5, 6 and 7, including higher repeat-offence ranges).
